Cost

I require an attorney fee deposit of $300 before we can file a chapter 13 bankruptcy. Most of a Chapter 13 bankruptcy attorney fee is paid through your repayment plan. Emergency Chapter 13 petitions may require a higher deposit. The minimum attorney fee for a Chapter 7 bankruptcy is currently $800 and subject to change depending upon the amount of work involved in your case. A Chapter 7 petition is not filed until your court cost of $299 and attorney fee is paid.

The United States Bankruptcy Court requires a Chapter 7 filing fee of $299 upon filing. The Chapter 13 filing fee is $274 which may be paid through your repayment plan. A $50 briefing fee paid to an independent consumer education group is now required before you can file any bankruptcy. The fee purchases a certificate which allows you to file a bankruptcy. After your Chapter 7 hearing, you must attend an education class within 45 days which costs $50 as well. This education class is free when you file a Chapter 13.
